California Court of Appeal

Albanese v. Menounos, B240866

In an action brought by plaintiff, a stylist, against defendant, a television personality, for defamation and other torts, the trial court's order denying defendant's motion to strike plaintiff's complaint under the anti-SLAPP statute is affirmed where: 1) there is no evidence that any of the disputed remarks were topics of public interest; 2) even assuming that plaintiff is a well known celebrity stylist and fashion consultant, there is no evidence that she was involved in a public controversy or that her fame is so great that her involvement in this private dispute is a matter of public interest; 3) therefore, the public interest requirement of Cal. Code of Civ. Proc. section 425.16(e)(4) was not met in this case; but 4) plaintiff's request for attorney fees is denied.
