In the published portion of the opinion, the drug program fee imposed on defendant must be reversed if the trial court reinstates the judgment of conviction because: 1) the trial court improperly delegated to the probation department the determination of defendant's ability to pay the drug program fee; and 2) the record does not support an implied finding of his ability to pay.
