In an action in which plaintiff alleged that defendant knowingly purchased the plaintiff's confidential documents from its former fundraiser, the trial court's order granting defendant's anti-SLAPP special motion to strike and awarding defendant attorney's fees is reversed, where: 1) the gravamen of plaintiff's action is the allegation that defendants wrongfully purchased its confidential documents; 2) said purchase was not an act by defendants in furtherance of their right of petition or free speech; and 3) in view of the reversal of the order granting the special motion to strike, defendants are not prevailing parties at this juncture and thus are not entitled to attorney fees in any amount.
