California Court of Appeal
Hebberd-Kulow Enterprises, Inc. v. Kelomar, Inc., D060438
Judgment awarding plaintiff damages on its breach of contract claims alleging defendant failed to pay for certain agricultural goods is reversed and remanded, where the trial court erred in ruling that the parties' contracts included an interest charge for late payments because there was no basis on which the court could conclude the parties intended the invoices to be the final expression of their agreement.
