The trial court's order denying defendant's special motion to strike plaintiff’s complaint under Code of Civil Procedure section 425.16, the anti-SLAPP statute is: 1) affirmed in part, where plaintiff's civil extortion claim is subject to dismissal under the anti-SLAPP statute because the demand letter did not constitute extortion as a matter of law; and 2) reversed in part, where plaintiff's claims for a violation of his civil rights and for intentional and negligent infliction of emotional distress are not subject to dismissal under the anti-SLAPP statute because they did not arise from protected activities.
