California Court of Appeal
Shearin v. Brown, B239730
The trial court's orders denying class certification and dismissing plaintiffs 1983 claims in an action seeking damages for allegedly being detained in prison beyond their lawful release dates are affirmed, where: 1) because there was substantial evidence supporting the trial court's findings that common issues did not predominate and that plaintiff's claims were not typical of the putative class members' claims, the trial court did not abuse its discretion in denying the class certification motion; 2) the order sustaining the demurrers to plaintiff's section 1983 claims is nonappealable.
