California Court of Appeal
Torres v. Department of Corrections and Rehabilitation, B242586
Judgment dismissing plaintiff's complaint alleging that he was falsely imprisoned when he was detained on an alleged parole violation after his parole expired by operation of law, is affirmed, where: 1) defendant's failure to file a timely claim as required by the Government Tort Claims Act precludes the filing of the lawsuit; and 2) the action is barred by Government Code section 845.8 which immunizes defendant from damages arising from the erroneous revocation of parole.
