California Court of Appeal

People v. Scott, H037923

The trial court's order sentencing defendant to county jail under the Realignment Act, following revocation of his probation, is affirmed, where defendant was properly sentenced under the Realignment Act provisions because the provisions of the amended statute should apply to those qualifying defendants who committed a crime now subject to a sentence in county jail prior to the passage of the Realignment Act, were placed on probation after execution of sentence was suspended, violated probation, and whose sentence was then executed after October 1, 2011.
