California Court of Appeal

People v. Ermi, B241397

Defendant's motion to suppress evidence of drugs found in her purse during a probation search of her probationer-boyfriend in the apartment they shared, was properly denied, where: 1) defendant's purse, which was on a chair in their bedroom, was subject to search because this was a repository over which the probationer had control or access; and 2) substantial evidence supports the trial court's express factual finding of control or access.
