Faulkinbury v. Boyd & Associates, G041702

Order denying plaintiffs' motion for class certification of current and former employees of defendant in suit alleging labor violations, is reversed and remanded, where the trial court erred by denying class certification of all three subclasses because: 1) common issues of fact predominate over individual issues in determining whether defendant was liable for not providing off-duty meal breaks, rest breaks, and paying overtime to its security guard employees; and 2) the requirement of ascertainability has been met for all three subclasses.
