Lockaway Storage v. County of Alameda, A130874

Judgment holding defendant-county liable for a temporary regulatory taking, and awarding plaintiff damages and attorney fees is affirmed, where: 1) the trial court was correct to rule that plaintiff's development project was unaffected by the passage of Measure D, and defendant's change of position, almost two 2 years after Measure D was implemented, was an unreasonable and unjust interpretation of the measure that effectuated a regulatory taking; and 2) the basis for the award of attorney fees is easily discerned from the record and was reasonably within the scope of the trial court's discretion.
