Plaintiff is precluded from obtaining a new trial in this matter to put on reformulated expert testimony, where the CA Supreme Court's holding that the trial court acted within its discretion in excluding the trial testimony of plaintiff's principal expert witness on lost profit damages on the grounds they were not foreseeable to defendants, where: 1) the CA Supreme Court's ruling is the law of the case; and 2) the stipulated judgment precludes a new trial on a new theory of damages.
