In dispute brought by plaintiff attorney, against former client for breaching the retainer agreement, judgment for plaintiff is reversed and remanded, where the trial court abused its discretion by permitting plaintiff to amend his complaint to conform to proof, that is, that plaintiff was entitled to recover for "all time spent" on the prior case because he had withdrawn for good cause, rather than a "combined hourly and contingency based rate" as alleged in the complaint.
