California Court of Appeal

Khani v. Ford Motor Company, B239611

Order disqualifying plaintiff's counsel on the ground that counsel previously had defended defendant in lemon law cases is reversed, where: 1) the evidence in this case does not establish that any information to which plaintiff's counsel was exposed during his representation of defendant would be material to his representation of plaintiff in this case; and 2) the trial court abused its discretion in concluding that the prior cases were substantially related to the current case just because they involved claims under the same statute.
