Mendoza v. Hamzeh, B239245
Order denying defendant's anti-SLAPP motion and requiring him to pay plaintiff's attorney fees under Code of Civil Procedure section 425.16 is affirmed, where: 1) defendant's threats to report criminal conduct to enforcement agencies and to plaintiff's customers and vendors, coupled with a demand for money, constitute criminal extortion as a matter of law, and 2) the anti-SLAPP statute does not apply to litigation communications which constitute criminal extortion as a matter of law.
