Judgment for plaintiffs, private lenders, in suit against defendant, a private mortgage broker, for negligence and breach of fiduciary duty after it was discovered that a loan plaintiffs had financed had been obtained through fraud and forgery, is reversed and remanded, where: 1) the trial court prejudicially abused its discretion in excluding evidence of title insurance procured by defendant because it was relevant to liability; but 2) the trial court properly declined to instruct the jury on superseding cause.
