The trial court properly denied a motion to compel arbitration brought by some of the defendants on the basis of the possibility of inconsistent rulings resulting from litigation with third parties, where because the mutual agency of all defendants is not a judicially admitted fact, the Kessler defendants' argument that defendants Pakravan, 218 LLC, and Newman are not "third parties" within the meaning of Code of Civil Procedure section 1281.2(c) lacks merit.
