Spinner v. American Broadcasting Companies, Inc., B239229

In an "idea submission" suit in which plaintiff alleged defendant ABC used his ideas submitted in 1977 to create and develop the hit television series LOST, summary judgment for defendant is affirmed, where: 1) plaintiff's showing of access to plaintiff's work is insufficient as a matter of law; and 2) defendant's evidence of independent creation is uncontroverted and dispels any inference of use as a matter of law.
