California Court of Appeal
People v. Mora, D062007
Trial court's execution of a suspended sentence as punishment for defendant's probation violation committing defendant to state prison is affirmed, where: 1) the trial court correctly determined that the Realignment Act did not apply because defendant was sentenced to state prison before October 1, 2011, her commitment to state prison upon revocation of probation does not violate the Realignment Act; 2) application of the Realignment Act only to defendants sentenced on or after October 1, 2011 does not violate equal protection.
