People v. Prunty, C071065

Conviction of attempted voluntary manslaughter and of assault with a firearm with criminal street gang enhancements is affirmed, where even if it could be found that defendant was a member of a smaller subset of the Norteños affiliated with his neighborhood, the evidence was sufficient for the jury to find that the Norteños as a whole qualify as a criminal street gang within the meaning of Penal Code section 186.22, even without evidence of collaborative activities or collective organizational structure between the various Norteño subsets.
