California Court of Appeal

People v. McCall, B236269

Defendant, a student midwife, was properly convicted of practicing medicine without certification, as charged, where although defendant may have also violated the Midwifery Act, her conduct above and beyond the failure to secure supervision (i.e. provided prenatal care, monitored vital signs, told mother baby had shoulder dystocia, delivered baby, injected Pitocin, and sutured tear) constituted, as the jury found, practicing medicine without certification, a felony violation of the general statute.
