Petition for writ of administrative mandamus brought by petitioner police officer seeking reinstatement, back pay, and damages after termination for misconduct, was properly denied, where: 1) substantial evidence supports the judge's determination that the CLETS and check fraud allegations were not barred by the statute of limitations; 2) the specifications concerning the Antioch incident were amply supported by the evidence of what occurred during the second entry, that petitioner engaged in un-officer like conduct; 3) termination was neither excessive nor an abuse of discretion; and 4) there was no conflict of interest in the City Attorney advising the Commission as proper screens were followed.
