California Court of Appeal

In re Ricky T., B239238

Sexual abuse of a child by a parent places the victim's male and female siblings who remain in the home at risk of similar aberrant sexual behavior, and here: 1) guardian grandfather's convictions of sexual abuse of his step-granddaughters gave rise to a presumption that juvenile grandson was at risk of harm in grandfather's care; 2) grandfather failed to rebut the presumption; 3) the juvenile court properly could rely on the presumption in declaring the juvenile dependent; and 4) even without the presumption, evidence showed that the juvenile was at risk of harm.
