Tomatoes Extraordinaire, Inc. v. Berkley, D059971

Judgment imposing personal liability on defendant-controlling officer under the Perishable Agricultural Commodities Act (PACA) for defendant-company's failure to pay outstanding invoices for produce, is reversed, where: 1) a retailer must meet both the one-ton and $230,000 requirements to qualify as a PACA dealer; and 2) plaintiff did not establish that defendant-company was a produce "dealer" within the meaning of PACA.
