California Court of Appeal
People v. Ellis, A133343
Defendant's convictions of sexual activity with a 13-year-old girl, of making the girl available to another adult for lewd and lascivious acts, and of encouraging and attempting to force the girl to work for him as a prostitute, are affirmed, where the disputed photographs taken during the victim's sexual assault examination: 1) were properly authenticated; 2) are not testimonial hearsay and thus the confrontation clause is not implicated; and 3) were properly admitted.
