California Court of Appeal
Soco West, Inc. v. California Environmental Protection Agency, G046549
The plain language of Health and Safety Code section 25187(b)(1)(A) unambiguously required defendant's Department of Toxic Substances Control (DTSC) to invoke the legal remedies available pursuant to Chapter 6.8 of Division 20 of the code after plaintiff voluntarily requested in writing that DTSC issue an order for plaintiff to take corrective action pursuant to that chapter, and as such, the judgment granting plaintiff's motion on the pleadings is affirmed, as modified.
