Petition for writ of mandate asking court to grant petitioner's request to have Dr. Catherine Scarf appointed as his defense expert, is granted, where: 1) to the extent that petitioner is only seeking the appointment for assistance in the defense and not to evaluate petitioner's competence to stand trial, he is entitled to the appointment of Dr. Scarf and is not limited to a psychotherapist from the Juvenile Competency to Stand Trial Panel; and 2) to the extent that petitioner is making a request for a Competency to Stand Trial evaluation, the attorney-client privilege applies to any disclosure made in conjunction with that evaluation.
