Habitat and Watershed Caretakers v. City of Santa Cruz, H037545
Judgment denying plaintiff's mandate petition, which contended that defendant failed to comply with the California Environmental Quality Act, is reversed, where: 1) defendant's Environmental Impact Report (EIR) adequately discussed and analyzed the impacts of the project, did not prejudicially misdescribe the project's objectives, contained adequate mitigation measures and findings, and an adequate statement of overriding considerations; but 2) the EIR was inadequate because it failed to discuss any feasible alternative, such as a limited-water alternative, that could avoid or lessen the significant environmental impact of the project on defendant's water supply.
