Contreras v. First Student, Inc., A134405

Paragraph 2 of an injunction issued by the trial court barring the individual plaintiffs, former employees of defendant's predecessor, from discussing with any current employees of defendant, a lawsuit alleging defendant failed to maintain and repair the defendant's buses as required by its contract with San Francisco Unified School District, is vacated, where: 1) there has been no finding of a rule violation by plaintiffs' counsel; 2) there is no evidence that plaintiffs' counsel indirectly violated the rule by instructing the individual plaintiffs to communicate with defendant's employees on counsel's behalf; 3) the injunction is not supported by evidence of Rule of Professional Conduct 2-100 violations; and 4) the order is not supported by evidence of witness tampering.
