California Court of Appeal

People v. Whitaker, C064531

Murder convictions are affirmed, where trial court erred in finding good cause to delay swearing in the first jury by basing its decision on a factor unrelated to jury selection, but this error does not require reversal of the convictions arising from the jury verdicts, because defendants have not suffered a double jeopardy violation or due process violation.
