California Court of Appeal

Pomona Valley Hospital v. Superior Court, B245224

Defendant's petition for writ of mandate is granted, where plaintiff’s counsel's declaration and three letters from the Hospital's Institutional Review Board are insufficient as a matter of law to support plaintiff's motion to amend her complaint against defendant hospital to allege punitive damages, and therefore respondent court is directed to set aside its order that granted plaintiff's motion to amend, and enter a new order denying the motion.
