California Court of Appeal
Natalini v. Import Motors, Inc., A133236
Defendant's petition to compel arbitration pursuant to a car sales contract was properly denied where: 1) the arbitration provision is procedurally and substantively unconscionable; and 2) because the provision is permeated with unconscionability, the trial court did not abuse its discretion in declining to sever the unconscionable aspects of the provision.
