California Court of Appeal

Ahdout v. Hekmatjah, B236764

Arbitration award is reviewable under the public policy exception to the general prohibition of judicial review of arbitration awards, because Business & Professions Code section 7031 constitutes a clear-cut and explicit legislative expression of public policy mandating the disgorgement of compensation received by an unlicensed contractor, and therefore the case is remanded for the trial court to conduct a de novo review of the evidence to determine whether disgorgement of compensation for defendant's construction work was required by section 7031.
