California Court of Appeal
People v. Navarro, B235448
In appeal of convictions related to shooting at a cohabitant from outside their mutual dwelling and evading arrest, judgment is affirmed, where: 1) on the evidence presented, the jury was entitled to conclude that defendant, who retrieved a loaded semi-automatic weapon and shot it at the door through which victim had just passed, had all the facts necessary to lead a reasonable person to understand that a battery would "directly, naturally and probably" result from his conduct; and 2) Penal Code section 136.1 is not overbroad, fatally uncertain or unconstitutionally vague.
