California Court of Appeal

Mooney v. County of Orange, G046262

In employment action for violations of Government Code sections 31725 and 31721(a), summary adjudication for defendant employer-county is affirmed, where plaintiff's claims fail as a matter of law because the undisputed facts show that plaintiff was neither: 1)"dismissed" by the defendant because of a disability, under section 31725, nor 2) "separated" from employment by the defendant, under section 31721(a). In the context of these statutes, “dismissed” and “separate” share the same meaning.
