In a suit for breach of contract involving an option to purchase film rights to a literary novel, the judgment of the trial court is affirmed where: 1) the trial court did not abuse its discretion in ruling that there was no prevailing party for purposes of attorney fees; 2) the trial court did not abuse its discretion by awarding defendant 7% interest on its restitution; and 3) defendant was a prevailing party under Code of Civil Procedure section 1032(a)(4), entitled to recover costs as a matter of right.
