In plaintiff's premises liability suit seeking to recover damages for the loss of its goods stored in defendant's warehouse, judgment of the trial court is: 1) affirmed as to the court's grant of summary judgment to the defendant on the ground that the action was time barred; 2) reversed as to the court's denial of plaintiff's motion to compel defendants to answer a set of special interrogatories where defendant was not entitled to raise plaintiff's lack of capacity as a basis for opposing the motion to compel; and 3) because the plaintiff should have prevailed on its motion to compel, the trial court erred in awarding sanctions against the plaintiff and its attorney.
