Trial court's order denying defendant's motion to disqualify an attorney and his law firm in three related actions involving claims by defendant's former business partner and the winding up proceeding of their company, is affirmed where: 1) the attorney does not represent the company in the derivative action; and 2) the attorney is not subject to disqualification based on a duty of fidelity or confidentiality.
