California Court of Appeal
Olofsson v. Mission Linen Supply, A131471
In plaintiff's suit for wrongful termination, alleging that he was fired in retaliation for having exercised his rights under the federal and state leave laws, trial court's judgment in favor of the defendant is affirmed where: 1) substantial evidence supports the trial court's decision that defendant did not misrepresent by deed that plaintiff's leave application was approved; and 2) substantial evidence supports the trial court's finding that defendant was not silent when it had a duty to speak under the applicable regulations.
