California Court of Appeal

Edgerly v. City of Oakland, A134047

In a former city administrator's suit alleging she was wrongfully terminated in retaliation for refusal to violate the city's charter, municipal code, and civil service rules and resolutions, trial court's judgment in favor of the defendant is affirmed where: 1) plaintiff's perceived violations of the city's charter and local rules and ordinances are not within the purview of section 1102.5, and her whistleblower claim fail as a matter of law; and 2) plaintiff has failed to raise a triable issue of material fact supporting her claim that she engaged in protected activity.
