Habitat & Watershed Caretakers v. City of Santa Cruz, H037545

In a petition challenging a city's certification of a final environmental impact report (EIR) for a project to amend the city's sphere of influence (SOI) to include an undeveloped portion of a university campus so as to permit the city to provide extraterritorial water and sewer services to the proposed new development, trial court's denial of the petition is reversed where: 1) the city's EIR misdescribed the project's objectives, and the misdescription skewed its consideration of alternatives; and 2) the EIR was inadequate because it failed to consider any potentially feasible alternatives that would avoid or limit the significant environmental impact of the project on the city's water supply.
