Hodjat v. State Farm Mut. Auto. Ins. Co., B233996
In plaintiffs' suit against their insurer for breach of contract and breach of implied covenant of good faith and fair dealing, arising from the insurer's denial of coverage on their alleged stolen automobile claim, trial court's grant of insurer's motion for summary judgment is affirmed where: 1) it was not an abuse of discretion in refusing to rule on plaintiffs' evidentiary objections for failure to comply with California Rules of Court, rule 3.1354; and 2) plaintiffs have failed to establish a triable issue of material fact where the insurance policy on their automobile clearly stated that there is no coverage if the policyholder gives false statements regarding the claim.
