Stockton Citizens for Sensible Planning v. City of Stockton, C067164
In plaintiffs' suit seeking to vacate a city's approval of a Wal-Mart Supercenter, trial court's judgment in favor of the defendants is affirmed where: 1) because plaintiffs' second cause of action alleging planning and zoning violations was not commenced within 90 days of the project's approval, it is time barred; and 2) because the remaining causes of action are dependent upon the timeliness of the second cause of action, those causes of action are barred as well.
