Chino MHC, LP v. CIty of Chino, E053467
In plaintiff mobile home park owner's suit challenging the city's denial of the plaintiff's application to convert the park to resident ownership, the judgment of the trial court is affirmed where: 1) although the city was entitled to consider the survey results, it could not deny the application based on the survey results unless they showed that the conversion was a sham; and 2) even aside from collateral estoppel, under the Permit Streamlining Act, once the city accepted the plaintiff's application as complete, it could not deny the application based on lack of evidence that the survey had been properly conducted.
