In plaintiff's suit against her neighbor for wrongful injuries to timber, trial court's judgment is: 1) affirmed as to the award of an additional $15,000 for loss of aesthetics; but 2) reversed as to the award of attorney's fees where section 1029.8, which authorizes a fee award against an "unlicensed person who causes injury or damage to another person as a result of providing goods or performing services for which a license is required, is inapplicable to the defendant because it was the day-laborer hired by the defendant to trim the trees, and not the defendant.
