Defendant's conviction for possession of rock cocaine for sale with a prior conviction for transporting a controlled substance and active participation in a criminal street gang, is affirmed where because defendant had the duty of bringing his Marsden motion to the trial court's attention at a time when the oversight could have been rectified, his failure to raise the issue before the matter proceeded to trial constituted abandonment of his claim.
