Barboni v. Tuomi, G045788

In plaintiff's personal injury action against her former employers for sustaining injuries after slipping and falling on defendants' driveway, judgment of the trial court in favor of the defendants is affirmed where: 1) the trial court properly considered competing juror declarations and found plaintiff failed to establish juror misconduct; and 2) the trial court did not abuse its discretion in permitting defendants to late designate their expert witnesses, and even if there was error, it did not constitute a miscarriage of justice requiring a new trial.
