In a parties' dispute over their respective voting rights in a mixed office and retail condominium development, the judgment of the trial court is reversed and remanded where: 1) the trial court erred in finding that the original owner and developer retained the Declarant's Class B voting rights; and 2) the lender's affiliate expressly conveyed to plaintiff any remaining Declarant's rights that it may have possessed at the time of the sale, and thus, plaintiff holds Declarant's rights, including Class B voting rights, as to any units that it still owns.
