California Court of Appeal

Fields v. State of California, F063128

In plaintiff's personal injury suit arising from a fatal automobile accident, brought against the State of California and the estate of the deceased driver who was involved in the accident, trial court's entry of nonsuit in favor of the state is affirmed where the state is not liable for any injuries the deceased caused to plaintiff when she drove to work from her appointment because driving was not one of her regular duties as a cook at the state prison, nor was injuring someone in an automobile accident a foreseeable risk of her job as a prison cook.
