In a conviction of a defendant for gross vehicular manslaughter, leaving the scene of an accident, and second degree murder, judgment of the trial court is: 1) affirmed as to the denial of a motion for a new trial based on juror misconduct where the jury did not commit misconduct by using a watch to time a period in question to consider the events that could have taken place in that period; 2) reversed as to defendant's sentence as the trial court erred in failing to dismiss certain counts and in connection with staying or failing to stay execution on defendant's sentence with respect to certain counts and enhancements; and 3) reversed as to the trial court's order awarding defendant presentence custody credits and failing to impose a criminal conviction assessment.
